Why instruct Graeme?

Graeme is a Wellington based taxation law specialist. Prior to setting up his law firm in 2010 Graeme was a senior solicitor with Inland Revenue (IRD). 

For more than 20 years Graeme worked in both Hamilton and Wellington assisting in investigations, providing technical tax advice and doing an extensive amount of Court work at all levels. 

In addition to the Taxation Review Authority, the High Court and the Court of Appeal, Graeme has also appeared in the Privy Council, London. 

Examples of cases in which Graeme appeared as Counsel:
  • Auckland Gas Ltd v Commissioner of Inland Revenue (2000) 19 NZTC 15,702 (PC)
  • Thomas Cook (New Zealand) Ltd v Commissioner of Inland Revenue [2005] 2 NZLR 722; (2004) 21 NZTC 18,933. The Privy Council determined the tax status for unclaimed foreign drafts.
  • Commissioner of Inland Revenue v Thompson (2007) 23 NZTC 21,375 (HC) This case (which subsequently went to the Supreme Court) concerned the issue of whether the taxpayer was entitled to de-register for GST.
  • TRA No 066/06 (2007) 23 NZTC 13,066. In this Taxation Review Authority case the company taxpayer applied to challenge assessments after the time bar had ended contending that there were exceptional circumstances.
  • Commissioner of Inland Revenue v Motorcorp Holdings Ltd (2005) 22 NZTC 19,126. This Court of Appeal decision concerned the CIR's assessment of GST liability on certain warranty payments in relation to imported cars.
  • TRA No 93/003 (2004) 21 NZTC 11,539 concerned claiming GST on the sale and purchase of a building which had previously been used as cinema and was partially occupied by several shops at time of sale.
